Terms for using PropertyBud's private seller-signal and seller-approved introduction platform.

These terms are not legal advice and require review by qualified legal, privacy, consumer-law, real-estate, conveyancing, payments, and direct-marketing advisers before use.

1. Who we are and what PropertyBud does

PropertyBud is a private seller-signal and seller-approved introduction platform for residential property opportunities. The service helps homeowners indicate, privately and at a high level, that they may be open to hearing from suitable buyers. It also helps buyers save search preferences, discover buyer-safe opportunity summaries, request seller-approved introductions, and communicate through platform messaging after an introduction is accepted.

PropertyBud is designed as a lead-generation and introduction platform only. PropertyBud is not a real estate agency, buyer's agent, seller's agent, property portal, valuation service, auctioneer, property manager, conveyancer, lender, broker, financial adviser, tax adviser, legal adviser, or negotiation service. PropertyBud does not act for, represent, advise, negotiate for, or owe fiduciary duties to any buyer, seller, agent, adviser, or other user.

2. Acceptance of these terms

By creating an account, submitting information, creating a Seller Signal, saving a buyer search, buying or using credits, requesting or responding to an introduction, sending messages, creating support tickets, or otherwise using PropertyBud, you agree to follow these terms and any service rules shown at the time.

If you use PropertyBud on behalf of a company, trust, partnership, agency, buyer's agency, or other organisation, you must have authority to bind that organisation. If you do not agree with these terms, you must not use the service.

3. Eligibility, accounts, and verification

You must provide accurate, current, and complete account information and keep it up to date. You are responsible for your account activity and for keeping your login credentials, devices, and contact details secure.

PropertyBud may require email verification, phone verification, profile completion, role selection, payment checks, abuse checks, or other trust and safety steps before you can access buyer, seller, credit, intro, messaging, support, or admin-reviewed features. Verification supports marketplace safety but does not guarantee a user's identity, authority, financial position, property ownership, buyer readiness, transaction intention, or ability to complete a transaction.

We may refuse, suspend, restrict, or terminate access if we reasonably believe an account is inaccurate, unsafe, duplicative, unauthorised, abusive, fraudulent, unlawful, high-risk, or inconsistent with the purpose of the service.

4. Seller Signals

Seller Signals are seller-controlled expressions of possible interest in hearing from suitable buyers. They are not formal listings, representations, warranties, offers to sell, contracts, agency appointments, valuations, appraisals, auction campaigns, open-home invitations, or promises that a property is available or will be sold.

Sellers are responsible for the accuracy, legality, completeness, and appropriateness of the information they submit. Sellers must not submit content that is false, misleading, discriminatory, unlawful, unsafe, invasive of another person's privacy, or inconsistent with their authority over the property.

PropertyBud may moderate, edit for display, approve, reject, pause, archive, expire, or remove Seller Signals. Approval for buyer-safe display means only that the signal passed an operational review for the platform; it does not mean PropertyBud has verified ownership, title, price expectations, property condition, planning status, defects, finance, legal risk, or any other transaction matter.

5. Buyer searches, matching, and opportunity summaries

Buyers may create saved searches and preferences so PropertyBud can identify possible matches and show buyer-safe Seller Signal summaries. Matching, fit explanations, scores, summaries, notifications, admin suggestions, and opportunity pages are informational only and may be incomplete, outdated, or wrong.

PropertyBud does not guarantee that any opportunity is suitable, available, below market, fairly priced, financeable, legally transferable, structurally sound, compliant, profitable, or likely to result in a purchase. Buyers must make their own enquiries and obtain appropriate professional advice before relying on any information or taking any step connected with a property.

6. Intro credits, introduction requests, and seller responses

Buyers may use intro credits to request a seller-approved introduction. Requesting an introduction holds one credit while the seller decides; it does not buy seller contact details, guarantee a response, guarantee an inspection, create exclusivity, create an agency relationship, reserve the property, or create a right to negotiate or purchase.

Sellers may accept, decline, ignore, or remove a Seller Signal before accepting. If a seller accepts, the held intro credit is consumed and a PropertyBud message thread can open. If a seller declines or the Seller Signal is removed before acceptance, the held credit becomes available again. If a request is still pending after 14 days, the buyer may rescind it and release the held credit; if the buyer does not rescind, the request and hold may remain pending.

PropertyBud may review disputed, unsafe, mistaken, duplicate, suspicious, or unfair intro outcomes and may grant a ledger-backed credit return, cancel an intro, restrict messaging, or take other platform action where appropriate. Payment refunds, support credits, and ledger adjustments remain subject to the service tools, Stripe processes, applicable laws, and any published refund or credit policy in force at the time.

7. Platform messaging and contact details

Accepted introductions may continue through PropertyBud platform messages. PropertyBud does not automatically reveal stored email addresses, phone numbers, exact addresses, private photo notes, payment details, or other private account information when an intro request is made or accepted.

Closing an accepted intro chat is not a deletion request for the shared message history. Closed history remains readable to both participants while retained, new messages are disabled, and any later pruning or anonymisation should be handled through separate PropertyBud retention processes.

Users may choose to share contact details or move off-platform at their own risk, but PropertyBud is not responsible for off-platform communications, inspections, negotiations, contracts, payments, deposits, due diligence, disputes, or conduct. Do not send passwords, card numbers, bank details, identity documents, or unnecessary private property details through messages or support tickets.

8. Payments, credits, and third-party processors

PropertyBud may offer paid credit packs, support credits, promotional credits, or other credit products. Prices, inclusions, expiry rules, credit-hold rules, refund rules, and availability may change. Any displayed taxes, fees, or checkout terms should be reviewed before purchase.

PropertyBud uses third-party providers, including Stripe, to process payments and refunds, and may use PostHog where enabled for product analytics. PropertyBud does not store full card numbers. Payment providers, authentication providers, hosting providers, analytics providers, email providers, database providers, bot-protection providers, monitoring tools, and other service providers may have their own terms, privacy policies, availability limits, and processing practices.

Unless the service expressly says otherwise, credits have no cash value, are not a stored-value facility, are not transferable, and may be adjusted or removed where required for fraud prevention, duplicate processing, refunds, chargebacks, misuse, legal compliance, or support resolution.

9. User content and licence to operate the service

You keep ownership of information, messages, notes, photos, Seller Signals, buyer searches, support content, and other content you submit, subject to any rights held by others. You grant PropertyBud a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, display, format, moderate, transmit, analyse, and otherwise use that content as reasonably needed to provide, secure, improve, support, audit, and operate the service.

You must have all rights and permissions needed to submit content to PropertyBud. You must not submit content that infringes someone else's rights, reveals another person's private information without authority, is defamatory, misleading, discriminatory, unlawful, harmful, malicious, or unsuitable for a property-introduction platform.

10. Acceptable use

You must not use PropertyBud to mislead people, impersonate others, submit false buyer or property information, scrape or harvest data, bypass seller approval, pressure users to reveal private details, spam users, interfere with the service, probe security controls, reverse engineer non-public systems, upload malicious content, misuse support, manipulate credits or payments, or engage in unlawful, discriminatory, abusive, fraudulent, unsafe, or exploitative activity.

You must not use PropertyBud to provide or imply professional advice, valuations, agency services, lending services, conveyancing, contract preparation, negotiation services, or other regulated services unless you are properly authorised and the service expressly permits that use. PropertyBud may remove content, block actions, or suspend accounts that create legal, safety, privacy, payment, operational, or reputational risk.

11. Professional advice and transaction responsibility

Property decisions can involve significant legal, financial, tax, lending, insurance, building, planning, title, and personal risks. PropertyBud does not provide professional advice and does not replace real estate, legal, conveyancing, building, pest, planning, financial, tax, lending, insurance, or other independent advice.

Buyers, sellers, and their advisers are solely responsible for due diligence, negotiations, inspections, price decisions, contract terms, finance, settlement, regulatory compliance, and any transaction they choose to pursue. PropertyBud is not responsible for whether any discussion, introduction, negotiation, or transaction succeeds.

12. Privacy and data handling

PropertyBud handles personal information according to the Privacy page and service-specific notices shown to users. By using PropertyBud, you acknowledge that the service needs to process account, verification, buyer-search, Seller Signal, intro, message, payment, support, analytics, notification, and audit information to operate safely.

Privacy-sensitive service rules are central to PropertyBud: public opportunity surfaces should show only buyer-safe Seller Signal fields; exact addresses, admin notes, preferred contact methods, stored contact details, and payment details are not automatically revealed to buyers.

13. Service availability and changes

PropertyBud is provided on an as-is and as-available basis. The service may be interrupted, delayed, unavailable, inaccurate, incomplete, changed, or discontinued during maintenance, provider outages, security incidents, service updates, legal updates, or operational changes.

We may add, remove, suspend, or change features, pricing, credits, matching rules, verification requirements, credit-hold rules, moderation rules, support processes, data retention defaults, or third-party providers. Material updates should be reflected in the service or in the date on this page.

14. Suspension, termination, deletion, and retention

We may suspend, restrict, or terminate access if we reasonably believe an account, Seller Signal, buyer search, message, payment, intro, support request, or other activity breaches these terms, creates risk, or requires review. You may stop using the service and may request account deletion where supported.

If your account is deleted, PropertyBud may deactivate your profile, archive seller activity, hide or soft-delete marketplace intent, cancel pending intro requests, close conversations, and retain records needed for support, audit, payment, fraud-prevention, safety, legal, reactivation, dispute, tax, accounting, and operational reasons. If you later return with the same verified email or verified phone, retained records may be relinked where the service supports reactivation.

15. Disclaimers

To the maximum extent permitted by law, PropertyBud disclaims all warranties, representations, guarantees, and conditions not expressly stated in these terms, whether express, implied, statutory, or otherwise, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, title, non-infringement, security, reliability, and suitability for any property transaction.

Nothing in these terms is intended to exclude, restrict, or modify rights, guarantees, remedies, or liabilities that cannot lawfully be excluded, restricted, or modified, including any non-excludable rights under Australian Consumer Law. Where permitted, our liability for breach of a non-excludable guarantee is limited to resupplying the relevant service or paying the cost of having the service supplied again.

16. Liability limits

To the maximum extent permitted by law, PropertyBud is not liable for property decisions, transaction outcomes, user conduct, seller or buyer statements, off-platform activity, third-party services, payment-provider issues, loss of opportunity, lost profit, lost data, business interruption, reputational harm, inaccurate user-provided information, or reliance on matching, summaries, notifications, opportunity pages, messages, introductions, or support outcomes.

To the maximum extent permitted by law, PropertyBud's total aggregate liability for claims arising out of or relating to the service is limited to the greater of the amount you paid PropertyBud for the relevant service in the 12 months before the claim and AUD 100. This limitation may not apply where the law does not allow it.

17. Indemnity

To the extent permitted by law, you agree to indemnify PropertyBud and its operators, employees, contractors, advisers, and service providers from claims, losses, costs, expenses, damages, liabilities, and demands arising from your misuse of the service, breach of these terms, unlawful conduct, content you submit, violation of another person's rights, off-platform dealings, or property transaction activity connected with your use of PropertyBud.

18. Governing law and disputes

These terms are governed by the laws of Victoria, Australia, unless a mandatory law requires otherwise. The courts with jurisdiction in Victoria may hear disputes connected with these terms or the service, subject to any rights that cannot be excluded under applicable law.

Before starting formal proceedings, users should contact PropertyBud support so the issue can be reviewed. Nothing in this section prevents either party from seeking urgent relief or using rights that cannot be excluded under applicable law.
